Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face alien smuggling charges, he was held in federal detention.
In her decision, the judge pointed out that the government does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
