The former personal attorney for Donald Trump has stepped down as New Jersey's top federal prosecutor. This follows a court battle that invalidated her right to hold the office.
Attorney General's Statement
The head of the Justice Department, Pam Bondi, accepted Habba's resignation on the start of the week. Bondi stated that the court's "flawed" ruling made it unworkable for the official to perform her duties.
"Do not interpret following the order as giving up," she declared. "The effort will now extend throughout the nation."
Judicial Challenge
Her resignation comes a week after a federal appellate panel ruled that she had been acting without proper authority as the federal prosecutor. This decision is could influence numerous prosecutions in the Garden State.
The appellate judges ruled that a interim role that bypassed Senate approval ran afoul of the statute on vacant positions.

It was also stated that she will remain at the DOJ as a top consultant. Habba plans to seek further review of the ruling, aiming for a different outcome.
Writing online, Bondi argued that the court "must not countermand the appointment of attorneys responsible for carrying out the primary duty of the administration of prosecuting crime."

Habba, originally became part of Trump's personal legal team in 2021. Subsequently, she represented Trump in his New York criminal case in 2024, which resulted in his guilty verdict on dozens of charges of falsifying business records.
Before Habba took on the top New Jersey post, Trump had stated he was naming her as his presidential counsellor during his second administration, describing the lawyer as a steadfast ally and a "tireless advocate for justice".
